Giuliani: I'd Investigate Clinton If I Were Still a US Attorney

Rudy Giuliani says that if he were still a U.S. Attorney, former Secretary of State Hillary Clinton would be the subject of a criminal probe for five crimes.

"I think it's outrageous that the Justice Department is not moving forward with this," the former mayor and one-time presidential candidate told CNN's "New Day" program Wednesday of the ongoing debate over Clinton's email servers.

"I believe she should be under investigation by the United States attorney in the Southern District of New York for obstruction of justice, for destroying government property," he told the program. "I think it's clear that she had a conflict of interest, her husband getting hundreds of millions of dollars, she’s making decisions about companies and about corporations that he’s getting money from. I think they filed a joint tax return."

But still, Giuliani said he would have allowed leniency toward former Gen. David Petraeus, who was found guilty of moving classified government documents off site.

"Gen. Petraeus, a lot of other people have gone to jail," said Giuliani. "Hillary Clinton, there are five acts we are talking about. Petraeus gave away one or two little things. She destroyed a drive with 34,000 emails on it."

Giuliani's words echoed those stated by GOP front-runner Donald Trump in Iowa on Saturday, who condemned her use of a private email server while secretary of state and also said that what she did is "far worse" than what Petraeus did.

He further claimed that Clinton is being protected by Democrats and the mainstream media, pointing out that The New York Times made changes to a recent story that initially reported that Clinton herself had sent classified information over her private email server, then changed it to reflect that someone had, but did not specify the person.

Also on Wednesday's show, Giuliani praised Trump's ability to draw audiences to the Republican presidential primaries, and said he can see the real estate mogul becoming president.

"I think Donald has been refreshing," Giuliani said. "The debate you're going to have next week is going to have three times the audience it would have had" without Trump being on the stage.

However, Giuliani, who ran as a GOP candidate in 2008, said he is not quite ready to endorse Trump or any other candidate at this point.
