Attorneys for a VICE News reporter suing for access to correspondence between the FBI and former Secretary of State Hillary Clinton shot back at the agency on Monday, saying in a court filing that it should produce evidence about its investigation if it wants to withhold documents.
The filing, on behalf of reporter Jason Leopold by attorneys Jeffrey Light and Ryan James, argued that the FBI must say who or what it is investigating if it wants to keep the documents private,
LawNewz.com reports.
Leopold filed a Freedom of Information Act lawsuit seeking any correspondence between Clinton and the FBI regarding her use of a private email server for government business.
The Justice Department in March sought summary judgment in the case, arguing that "there is a pending or prospective law enforcement proceeding" that could be impeded by the documents' release.
Light and James, in their filing on Monday, argued, "To show such a nexus, 'the agency should be able to identify a particular individual or a particular incident as the object of its investigation and the connection between that individual or incident and a possible security risk or violation of federal law.'"
The attorneys say the FBI must demonstrate that the documents must be withheld because they related to an investigation of the violation of a federal law or that the release would compromise national security, LawNewz notes.
