Texas Rep. Louie Gohmert called the U.S. Supreme Court’s ruling on Obamacare “illegitimate” and said Justice Elena Kagan should be impeached because she served as U.S. Solicitor General when the law was passed.
“We still have the issue of Justice Kagan,” Gohmert told Think Progress, the liberal blog of the Center for American Progress Action Fund, on Thursday outside the Supreme Court.
“Either she was totally derelict and negligent in her duties as Solicitor General and had absolutely nothing to do with the most important bill to the president, her boss, or she did have something to do with it.
“She has violated federal law, and as such she needs to be removed from the Supreme Court.”
Kagan was named to the court last fall.
As such, Gohmert said, her casting a vote in support of the Affordable Care Act made the 5-4 decision “illegitimate.”
“This decision would be illegitimate if she lied in order to get onto the court,” he said.
In its decision, the court upheld the centerpiece of President Barack Obama’s healthcare overhaul law that requires most Americans to get insurance by 2014 or pay a financial penalty.
In another part of the decision, and in a blow to the White House, a different majority on the court struck down the provision that requires the states to dramatically expand the Medicaid health insurance program for the poor.
