Sen. Tom Cotton, R-Ark., said Monday that President Donald Trump ought to fire Leandra English, who claims to be the lawful acting director of the Consumer Financial Protection Bureau.
"The Consumer Financial Protection Bureau is a rogue, unconstitutional agency. Leandra English's lawsuit to install herself as acting director against the president's explicit direction is just the latest lawless action by the CFPB," Cotton tweeted.
"She doesn't have a legal leg to stand on, as her own general counsel has conceded and the Department of Justice has concluded. The president should fire her immediately and anyone who disobeys Director Mulvaney's orders should be fired summarily. The Constitution and the law must prevail against the supposed resistance."
English was named deputy director by outgoing agency head Richard Cordray before he left his post. According to the Dodd-Frank Act, which created the CFPB, the deputy director "shall" assume the role of acting director until a new one is confirmed. However, the White House and the CFPB's general counsel claim that the president may appoint an acting head until a permanent one is confirmed.
