Tom Cruise Lawsuit: Actor Sues Magazines Saying He's a Bad Father

Tom Cruise's defamation lawsuit against the publisher of In Touch and Life & Style magazines continues, with the actor describing in a court filing his close and nearly constant communication with his daughter Suri.

Cruise filed the lawsuit against Bauer Publishing Co. in October 2012 after tabloid stories claimed he abandoned Suri after his divorce last year from her mother, actress Katie Holmes.

"She is a very happy child and we have a wonderful relationship and cheerful phone calls," Cruise, 51, wrote in a two-page description, according to ABC News. Suri, now 7, “has never indicated, in words or substance, that she has ever felt abandoned by me," Cruise wrote.

ABC News obtained the lawsuit and reported that Cruise's lawyer sent the publisher a letter on July 18, 2012, objecting to Life & Style’s July 30 cover headline "Suri in Tears, Abandoned by Her Dad" and story titled "Suri's Emotional Struggle." The lawyer wrote that the actor had spoken to Suri regularly while shooting and had he had been with her the day before the issue was published.

The lawsuit also references an Oct. 1, 2012, issue of In Touch that showed Suri on the cover with the headline "Abandoned By Daddy."

Despite filming two consecutive movies overseas, Cruise said he received updates from Holmes and spoke to his daughter almost daily.

“I have in no way cut Suri out of my life — whether physically, emotionally, financially or otherwise,” Cruise wrote, according to The Associated Press.

Bauer Publishing also filed court documents, writing that at the time of publishing, Cruise had not seen his daughter in 44 days.

Bauer’s lawyers argue that a judge should reject Cruise’s motion, the AP says. Their lawyers also say they turned over files to Cruise’s legal team information from confidential sources that the actor had missed Suri’s first day of school when he could have flown to see her.
