DACA recipients can apply for renewals following an injunction issued by a federal judge last week ordering the Trump administration to resume the program, the New York Times reports.
The Deferred Action for Childhood Arrivals, or DACA, allowed people who illegally came to the United States as children with their parents to stay if they met certain criteria. Trump ended DACA in September with a six-month delay and said Congress needed to come up with a solution for the affected Dreamers.
But a federal judge in California temporarily blocked the administration’s decision while state lawsuits against the government play out in court. DACA has protected about 800,000 people who were brought to the U.S. illegally as children or came with families who overstayed visas, and the program includes hundreds of thousands of college-age students.
In a statement, the U.S. Citizenship and Immigration Services said DACA participants whose DACA expired on or after Sept. 5, 2016, could request a renewal. Participants whose deferred action expired prior to Sept. 5, 2016, and anyone whose deferred action had been terminated could not renew but could instead file a new request. USCIS also said it would not accept new requests from individuals who have never been granted deferred action.
