House Dems: Same Judge Should Decide Mueller-McGahn Cases

House Democrats argued Monday that the same federal judge should decide if they can obtain materials from the grand jury impaneled by former special counsel Robert Mueller, as well as testimony from former White House counsel Don McGahn.

In a nine-page filing by House general counsel Douglas Letter, Democrats on the House Judiciary Committee argued that both cases sought evidence regarding a possible impeachment of President Donald Trump, The Hill reported Monday.

"Both seek key evidence for the Judiciary Committee's investigation into whether to recommend articles of impeachment against President Donald J. Trump for potentially criminal obstructive conduct," the Democrats said.

"The same underlying Committee investigation of the same Presidential misconduct is at the heart of both matters before this Court," the lawmakers wrote.

Further, "judicial economy" would be best in having the same judge rule in both cases.

As such, the cases could be decided by Chief Judge Beryl Howell of the U.S. District Court for the District of Columbia, the Hill reported. She has been assigned the case on the Mueller grand jury information.

House Democrats and Justice Department officials are expecting a decision in the case after Sept. 30.

The Judiciary Committee, headed by Rep. Jerrold Nadler, D-N.Y., sued last week to enforce the subpoena for McGahn's testimony.

The panel argued that the testimony was critical to determining whether to formally bring articles of impeachment against Trump, the Hill reported.
