House Dems Call on Justice Alito to Recuse From Jan. 6 Cases

A group of more than three dozen House Democrats on Tuesday released a letter calling on Supreme Court Justice Samuel Alito to recuse himself from any future cases involving the Jan. 6 Capitol riot that come before the Court in the future.

The Hill reported that Reps. Hank Johnson, D-Ga., and Dan Goldman, D-N.Y., led the letter, which calls on Alito to recuse himself from the Court's upcoming decision on whether former President Donald Trump is immune from prosecution over the Capitol riot, as well as all other future cases involving the incident.

Alito has come under fire following a report from The New York Times showing the American flag flying upside-down outside Alito's home about two weeks after January 6, 2021. The display of an upside-down flag was widely associated at the time with supporters of Trump who believed President Joe Biden's election was fraudulent.

Alito claims that his wife, Martha-Ann Alito, flew the flag upside-down due to a dispute with their neighbors.

"Your own public statement attempts to pass responsibility to your wife, but you nonetheless acknowledge that it was a political statement in support of Donald Trump's effort to overturn the 2020 election," the 45 House Democrats wrote in a letter addressed to Alito.

"Even if you had 'no involvement' in the display yourself, the fact of such a political statement at your home creates, at minimum, the appearance of improper political bias," they continued.
