Napolitano to Newsmax: Accused CEO Killer Might Face Death Penalty

Former Judge Andrew Napolitano told Newsmax on Thursday that if accused killer Luigi Mangione is "is prosecuted by the feds for murder as an act of terrorism, he is death penalty eligible."

Mangione was accused of shooting and killing UnitedHealthcare CEO Brian Thompson, 50, on Dec. 11 outside of the New York Hilton Midtown. Mangione, 26, faces one count of murder, two of second-degree criminal possession of a weapon, one count of second-degree possession of a forged document, and one of third-degree criminal possession of a firearm, according to court documents.

Napolitano said that if federal prosecutors charge Mangione, it will take the case away from Manhattan district attorney Alvin Bragg. Mangione was scheduled to appear in a Pennsylvania court Thursday morning for a hearing on a request by New York to extradite him to Manhattan to face murder charges.

"I think they're [federal prosecutors] probably trying to decide whether they want to get involved," Napolitano said on "Wake Up America." "They usually don't get involved in cases like this. Even though this was planned and plotted and lying in wait. And it's a classic first-degree murder."

Napolitano said if the federal government brings charges, that will increase the punishment for Mangione.

"Even though the state says he did this in order to intimidate and terrify the civilian population, this is not a typical case for the federal government to get involved. But if they do, the death penalty is available," Napolitano said.
