If the Department of Justice (DOJ) persists in refusing to hand over the audiotape of former special counsel Robert Hur's interview with President Joe Biden concerning the classified documents investigation, then there will be no choice but to hold Attorney General Merrick Garland in contempt of Congress, Rep. Andy Biggs, R-Ariz., told Newsmax.
If the DOJ is "not going to provide us with the information that we have every authority to request and demand with a subpoena, then there is no other alternative but to go forward with a contempt citation," Biggs, a member of the House Oversight Committee, told Tuesday's "Wake Up America."
Biggs said the reason the DOJ is refusing to hand over the audiotapes is "they lose control if we get the audiotapes," pointing out if someone just reads a transcript of what someone said, it makes a certain impression, but nearly as much as when someone listens to an audiotape.
The congressman emphasized DOJ officials are particularly "afraid that it may actually confirm what so many of have suggested — one of two things — [Biden] has willfully withheld classified information or he is perhaps mentally incompetent and challenged at this point."
When asked if he would vote to oust House Speaker Mike Johnson, R-La., Biggs was noncommittal, but said he is "gravely disappointed with some of his actions."
Biggs said if Johnson "is going to continue on a path of bad policy and actually undermine what we should be doing, then it is an option" to throw him out of his post.
Johnson bringing Ukraine funding to a House vote is problematic for Biggs, who stressed this "perpetuation of bad policy is a bad way to get Donald Trump elected."
"You better do good policies and do what Republicans want you to do," Biggs concluded.
