The seven red states trying once again to kill off the federal program that protects kids who entered the U.S. with their illegal-alien parents from deportation will lose their battle, Bill O'Reilly told Newsmax TV on Wednesday.
That is because Texas, Alabama, Arkansas, Louisiana, Nebraska, South Carolina, and West Virginia, which filed suit this week to end the Obama-era Deferred Action for Childhood Arrivals (DACA) program, are seeking to quash a legally solid decision.
"These states are going to lose because any president has the right to issue an executive order, which Barack Obama did, which basically said this class of illegal immigrant can stay," the bestselling author and host of "No Spin News" told host John Bachman.
"That's what DACA's about. So, the president has the right to do that. The Supreme Court is not going to say he doesn't have the right, because it's clear that he does. So, that's a loser. It's the wrong way to do it.
"But constitutionally, Barack Obama had the right to make the executive order and Donald Trump has the right to undo it. So, remember that's in play, too."

The states involved in the lawsuit are not directly addressing the rulings by three judges who have all blocked Trump from rescinding DACA. Instead, they contend the program was not constitutional when it was first enacted in 2012.
