The U.S. Constitution will be in serious trouble if a federal appeals court fails to back President Donald Trump's temporary immigration ban, Mike Huckabee says.
"Even the most liberal of SCOTUS justices must realize that if they uphold [Washington State Federal District Court] Judge Robarts' stay on Trump's temporary immigration ban, it will not only contradict their own previous rulings … it will throw a hand grenade into settled federal law and the Constitutional separation of powers," the former Arkansas governor wrote on his Facebook page.
For example, Huckabee said, why would Arizona have no right to challenge President Barack Obama's power over immigration, but Washington State has the right to usurp President Trump's power over immigration?
He added that a failure by the U.S. Court of Appeals for the Ninth Circuit to restore Trump's order would mean district judges and states have more power over national security than the president.
As well, corporations would have legal standing to sue to block immigration laws "because it would harm them to lose cheap immigrant labor," Huckabee suggested.
"Upholding it would render our system of laws regarding immigration and border security into chaos. If everybody is in charge, then nobody is in charge," he said.
"And the judge's ruling apparently isn't based on any grounds other than his own quixotic feelings. He didn't even get his facts right, basing his rejection of the need for the ban on his unresearched belief that there have been no arrests of foreign nationals from those nations since 9/11."
The Ninth Circuit court is weighing whether to reinstate the ban after Robart of Washington blocked it over the weekend — prompting a furious Trump to brand him a "so-called judge."
