Rudy Giuliani said he was "shocked" by the report that a possible spy had infiltrated the Trump 2016 campaign, saying that the president's legal team will look into challenging "the legitimacy of the entire" Russia investigation.
Giuliani was reacting to The New York Times story that detailed the operation — code name "Crossfire Hurricane" — by former President Barack Obama's FBI to spy on the campaign of President Donald Trump.
"I'm shocked to hear that they put a spy in the campaign of a major party candidate, or maybe two spies," Giuliani said Thursday on Fox News' "Fox & Friends" program. "That would be the biggest scandal in the history of this town, at least involving law enforcement."
Giuliani said if the report is true, it's further evidence that there was no collusion between the campaign and Russia.
"That spy should have been enough to tell them, these people were not talking to the Russians," Giuliani said. "If they had incriminating evidence, they'd be able wrap this investigation up. … I wouldn't be sitting here."
Giuliani went on cable TV Wednesday night to assert that special counsel Robert Mueller can't indict the president, and on Thursday took it a step further — Mueller can't actually subpoena the president to testify either.
"We're pretty comfortable … they wouldn't be able to subpoena him personally," Giuliani said. "They can't require you to testify in what would be your own case because, after all, it's all about a possible impeachment. Impeachment has to come before indictment."
Regardless, Giuliani maintains that Trump wants to talk with Mueller, and the president's legal team would allow that if Mueller "had an open mind" and was "willing to be reasonable."
"The president wants to testify. He keeps saying to me, 'I never talked to any Russians, I had nothing to do with any Russians, what is this nonsense about Russians?'" Giuliani said.
"We're going to be the laughingstock of lawyers if we let him testify," Giuliani said. "But we're only going to do that if we feel there's a way to shorten this thing. If we're in for a long investigation, we'll fight every single thing.
"If you're innocent, you gotta fight back. And the president is completely innocent. It's a damn witch hunt," Giuliani said.
