Kobach: It's 'Possible' Sanctuary City Mayors Can Be Arrested

Kansas Secretary of State Kris Kobach said Wednesday "it is certainly possible" the mayors of Chicago and New York City could be arrested for leading "sanctuary cities."

When asked if Mayors Rahm Emanuel and Bill de Blasio could be put "in cuffs," Kobach told Wednesday's Fox News' "Fox and Friends": "Well, it is certainly possible.

"There is a section in our criminal code dealing with immigration that makes it a crime to encourage or induce an illegal alien to remain in the country knowing he is illegal alien or with reckless indifference to the fact that he is probably an illegal alien. That is the actions by these city councils to create these sanctuary laws, actually would fall within that crime.

"Now, it is up to the Justice Department to decide whether they want to charge them with it. This crime has been on the books since 1952. In the past it has been used to charge, say a business owner who provide incentives for illegal aliens to remain and keep working for him. That, he is helping maybe four or five illegal aliens. These city leaders are helping 4-500,000 illegal aliens. So, the gravity of their actions is far greater than people spending time behind bars have done."

Kobach then claimed illegal aliens' "criminality is twice that of comparable American population. We saw a study out of Arizona. It is bad for America. If you grant [Deferred Action for Childhood Arrivals] amnesty. . . . You have to make it mandatory to make sure . . . another flood of illegal aliens . . . are not stealing jobs from Americans as well.

He concluded "the Democrats are not willing to give anything. At this point I don't see how there is any deal on the table."
