Birth Control Packaging Defect Sparks Lawsuit for Unplanned Pregnancies

More than 100 women are suing a birth control manufacturer, alleging that incorrect pill packaging led to unplanned pregnancies.

According to ABC News, pill packages made by Qualitest Pharmaceuticals, part of Endo Pharmaceuticals, were "rotated 180 degrees . . . reversing the weekly tablet orientation," the suit claims.

With the packages allegedly reversed, the women took placebo sugar pills meant for the week of menstruation at the wrong time, and became pregnant.

The lawsuit was brought by 113 women in 28 states on Nov. 5 in the Court of Common Pleas of Philadelphia. A total of 94 of the pregnant women gave birth, while 17 did not.

Collectively, they seek millions of dollars as compensation for pain, suffering, lost wages, and child-rearing expenses.

As CNN reported, Qualitest Pharmaceuticals voluntarily recalled the lots of birth control pills in September 2011.

The FDA said that the packaging did not pose an immediate health risk. Court documents filed in April said that 3.2 million pill packs were recalled.

"The voluntary recall occurred based on an extremely small number of pill packs that were manufactured by an external contract manufacturer," Endo Pharmaceuticals said in a statement.

"Endo has been able to confirm only one blister pack that manifested a defect and was sold to a patient. Additionally, courts have dismissed cases arising out of the recall because the plaintiff could not establish that she purchased a defective package."
