A Clinton email probe search warrant is set to be released Tuesday after a U.S. judge called for the unsealing of documents that allowed the FBI to investigate more emails related to the former Democratic presidential candidate’s private server just days before the election.
On Monday, U.S. District Judge P. Kevin Castel said the public has a right to see the warrant, which was filed on October 30, reopening a can of worms for Clinton just days before she attempted to make history as the first female president, ultimately conceding to President-elect Donald Trump, Fox News reported.
“The search warrant, the application for the search warrant, the affidavit in support of the application for the search warrant, and the search warrant return will be unsealed and posted on the Court’s electronic case filing system,” Castel said in the order.
The warrant will be made public on Tuesday unless a higher court steps in to block the release, according to The Hill.
The documents could give the public some insight into why the FBI was so set on searching Clinton’s emails just 11 days before an election.
Federal prosecutors were initially against unsealing the search warrant, but agreed to do so with redacted information, The Hill reported.
FBI Director James Comey alerted Congress about the newly discovered emails on October 28, according to Reuters.
The discovery of additional Clinton private server emails was reportedly made during the course of a separate investigation into former Democratic U.S. Representative Anthony Weiner, the estranged husband of Huma Abedin, Clinton's top aide.
Just two days before Trump’s presidential victory, Comey announced that the new set of emails discovered in the Weiner investigation would have no significant impact on Clinton’s case.
The Clinton email controversy first sparked in March 2015 when it was revealed that she had used a private email server during her stint as the secretary of state from 2009 to 2013.
Despite Clinton’s “extremely careless” handling of classified information, which is believed to have been shared in the emails, Comey decided not to bring any criminal charges against Clinton in July.
