“There are no charges, definitely not. There is an investigation regarding an allegation," Rene Pimentel, spokesperson for the Miami Police Department, told USA Today Sports.
TMZ Sports first reported the alleged incident and obtained a police report.
Although some reports termed it a sexual assault allegation, no mention of sexual assault was made the police report. TMZ pointed out that the woman’s name was blacked out in the report, which typically happens when there’s a sexual nature to the situation.
TMZ said the report was from a woman who claimed she was at Lockette’s apartment at the Viceroy in Miami on April 1. During the evening, she said she was encouraged to take a hit of marijuana on a bong. She told police she felt dizzy and laid down in a bedroom, where she said Kaepernick followed, kissed her, and undressed her. He apparently then left the room, and Patton and Lockette opened the door and she said she told them to get out.
The report quoted the woman as saying she passed out and didn’t remember anything after that, until she woke up in a hospital room, TMZ said, adding that the woman told police she had a previous sexual relationship with Kaepernick.
“The 49ers organization is aware of the recent media report regarding Colin Kaepernick and is in the process of gathering the pertinent facts," 49ers general manager Trent Baalke said in a statement, USA Today reported.
