The 2016 Sochi Olympics will go on without three-time U.S. figure skating champion Johnny Weir who missed the deadline.

Weir, who competed in the previous two Olympic games, missed the Sept. 1 deadline to register to qualify for the national championships, where the Sochi team will be chosen, U.S. Figure Skating confirmed to The Associated Press on Tuesday.

Weir isn't eligible for a bye, either. U.S. Figure Skating policy states that only players who placed in the top five at last year’s nationals or who won at the most recent Olympics or world championships are eligible for them.

Weir, 29, did not comment when contacted by The Associated Press.

Weir hasn't competed since withdrawing from last year's Rostelecom Cup, his first event since finishing sixth at the Vancouver Olympics.

Meanwhile, former U.S. champions Rachael Flatt and Alissa Czisny are returning for the qualifiers. Flatt, the 2010 U.S. champ, and Czisny, who won in 2009 and 2011, missed last year's competition because of injuries. They needed to finish in the top four at regional and sectional competitions to secure spots at the U.S. championships.

Last month, Weir spoke out about Russia's anti-gay laws, which ban the discussion of gay rights and relationships within earshot of children. Weir is married to a man of Russian decent, and he wouldn't be allowed to appear at the event with his own husband.

Weir would risk being arrested in the nation if he went to Russia to compete.

"If it takes me getting arrested for people to pay attention, and for people to lobby against this law, then I'm willing to take it," he told CBS last month.
