Report: Rep. Michael Grimm Consults Boehner, Decides to Resign

Embattled Rep. Michael Grimm will resign from the House after pleading guilty to felony tax evasion charges, a report says.

The New York Daily News reports that Grimm, a New York Republican, decided to resign after consulting with House Speaker John Boehner on Monday.

Sources told the newspaper that Grimm would announce his resignation either Tuesday or Wednesday.

Grimm pleaded guilty last week to one count of aiding in the filing of a false tax return. He was previously scheduled to go on trial in February on charges that he kept more than $1 million in sales and wages from his Manhattan health-food restaurant outside the federal tax system.

After his guilty plea, which was unexpected, a judge set his sentencing hearing for June 8. Prosecutors are looking for a prison term of 24 to 30 months, while Grimm's defense attorney wants that reduced to 12 to 18 months.

A former Marine and FBI agent, Grimm won re-election in November by a 55 percent to 42 percent margin despite his legal troubles. He was slated to be sworn in Jan. 6.

Grimm was indicted in April. He also was accused of lying under oath in 2013 about his role in the restaurant.

There had been several calls for Grimm's resignation, but he vowed to stay in office for as long as possible. It appears Monday's meeting with Boehner changed his mind.

The Daily News reports that New York Gov. Andrew Cuomo will call a special election to fill Grimm's soon-to-be-vacant seat.
