Judge: James Holmes Sanity Exam Can be Recorded

The judge in the Colorado theater shooting case says defendant James Holmes' second sanity evaluation of can be video-recorded despite his lawyers' objections.

It isn't clear from Thursday's ruling whether the video could be shown to jurors.

The defense objected to videotaping, saying the law doesn't authorize it and it might interfere with the results.

The judge said the law doesn't prohibit recording and the defense didn't demonstrate that it would interfere.

Holmes pleaded not guilty by reason of insanity to charges of killing 12 people and injuring 70 in the 2012 attack.

He underwent a sanity evaluation last summer but the judge ruled it was flawed and ordered another.

The psychiatrist who will conduct the new exam says video provides a better record than handwritten notes.
