Hillary Clinton "committed a crime" by using a private email server, GOP presidential candidate Donald Trump said Tuesday night, but she'll probably get away with it because of Democrats in high places in the government.
"You have Democrats [who] are all the prosecutors and they don't want to prosecute it," the New York businessman told
Fox News' "Hannity" show host Sean Hannity. "Did she commit a crime? Yes. Will they prosecute it? Perhaps no."

Clinton's attorney turned the private mail server she used while secretary of state over to the FBI, as well as a thumb drive of work-related emails.
Her use of a private email server has drawn fire from political opponents like Trump, who say that by not using a government server, she violated transparency protocol and record-keeping laws.
Clinton's account was linked to a server in her own home in New York.
Four classified emails have been found on the private email server, with two marked "Top Secret,"
according to McClatchy, and the inspector general for the intelligence community has told key members of Congress about the top-secret classification, Fox News Channel has confirmed. The other two emails are still under review to determine how they should be classified.

Clinton's emails are in the possession of her personal attorney, including the ones that require a security clearance to read, according to Fox News.
The inspectors general noted that the information was not marked as classified when Clinton's lawyer received it on a thumb drive.
Trump told Hannity that when the email scandal is added in with issues surrounding contributions to the Clinton Foundation, it combines to make a serious situation.
And Gen. David Petraeus, who did "a tiny fraction of what she did, his life is destroyed. He has been ruined," said Trump, speaking of the former CIA director who retired from the military and public service after it was disclosed that he had allowed his ex-mistress to have access to classified information.
Trump said that while he gave contributions to politicians as a businessman, "when Jeb Bush raises $114 million, which he has, when Hillary raises $60 million, which she has, I know the people that gave them the money. These are not the nicest people in the world."
But, he told Hannity, he would not be controlled by campaign donors because he's relying on his own wealth.
"My income is $400 million per year," Trump said. "Sure, I would spend it — if I'm doing well."
