ACLU Sues Over Expedited Deportations

The American Civil Liberties Union announced it has filed a lawsuit over President Donald Trump’s plans to carry out swift deportations.

A new rule enacted by the Department of Homeland Security allows for migrants to face expedited removal if they cannot prove they’ve been here for two years. An expedited removal means migrants can be removed without a full hearing if they don’t have an asylum claim.

"The Administration’s decision to expand expedited removal to a vast group of non-citizens living anywhere in the United States disregards nearly three decades of experience showing that the expedited removal process, even when used at the border for new arrivals, is rife with errors and results in widespread violations of individuals’ legal rights," the ACLU wrote in its complaint

The ACLU argues the new rules violate federal immigration law and the right to constitutional due process.

The Biden administration relied heavily on expedited removals after ending Title 42, which allowed for migrants to be swiftly expelled, barring them from seeking asylum. 

"Everyone in this country is entitled to due process — it is one of the core tenets of our government," Arlenis Morel, Make the Road New York’s co-executive director, said in a statement.  

The ACLU is representing the group in the suit.

This is the second lawsuit the ACLU has filed against the new Trump administration. The group is also suing over Trump’s executive order restricting birthright citizenship.
