Legal Group Files Civil Rights Complaint Against Disney

The conservative nonprofit group America First Legal (AFL) filed a federal civil rights complaint against Disney for practices that intentionally discriminate "against White men, Christians and Jews."

In its 16-page complaint filed to the Equal Employment Opportunity Commission (EEOC) on Wednesday, AFL accuses Disney of unlawful racial discrimination for violating Title VII of the 1964 Civil Rights Act.

AFL includes in its complaint documents that were leaked this month to Elon Musk, including a requirement that 50% of certain jobs be filled by members of "underrepresented groups." Those jobs include regular and recurring actors and characters in Disney content; producers and writing staff; overall crew or project staff; and line producers and/or production department heads.

"Disney appears to be engaged in pervasive, far-reaching, and illegal race and sex discrimination in violation of the 1964 Civil Rights Act," AFL President Stephen Miller said in its release. "Accordingly, we have filed a formal complaint with the EEOC that Disney is engaged in illegal conduct.

"It is sad and tragic that a company whose name was once synonymous with wholesome and charming childhood fantasies is now dedicated to spreading divisive bigotry. ... We urge Disney to cease and desist its unlawful and destructive conduct at once."

Musk on Feb. 8 published Disney's DEI standards on X, the social media platform that he owns. In one post, Musk said Disney's diversity programs are "enforced by Disney's DEI Gestapo."

"It is patently unlawful to consider racial, ethnic, and sex-based characteristics in hiring, training, compensation, and promotion," AFL wrote to the EEOC. "Decades of case law have held that policies that impose racial balancing or quotas in employment, training, or recruitment, such as those presented on Disney's websites, are prohibited."

The EEOC does not have to act on the complaint.  

Musk posted Disney's "inclusion standards," a document he said came from an anonymous source. He also posted an invitation to receive legal support for anyone who was discriminated against by Disney.
