Supreme Court Justice Brett Kavanaugh said judges owe “allegiance to the Constitution” as he stressed judicial independence, CNN noted.
His comments came Monday night at a conference for judges and lawyers in Milwaukee, Wisconsin. Appearing on stage with Kavanaugh was retired Justice Anthony Kennedy, the man he replaced on the high court.
Kavanaugh was asked if he agreed with Chief Justice John Roberts’ remarks in November about judicial independence.
Roberts had said: “We do not have Obama judges or Trump judges, Bush judges or Clinton. What we have is an extraordinary group of dedicated judges doing their level best to do equal right to those appearing before them."
And Kavanaugh said: “We owe our allegiance to the Constitution."
He showed the audience a small copy of the Constitution he keeps in his jacket pocket. Kavanaugh said he has had the copy since working as a law clerk for Kennedy in the 1990s,
He added: “It’s important for judges not to be in a bubble.”
Kavanaugh noted the respect he had for Kennedy and said when writing an opinion or posing a question during oral arguments, he often asks himself: “What would Justice Kennedy do?”
