Texas Attorney General and Gov.-elect Greg Abbott says he will sue President Barack Obama on behalf of his state as soon as Obama announces that he is taking executive action and granting legal status to millions of illegal immigrants.
Obama is scheduled to announce his plans Thursday night.
Appearing on
Fox News Channel's "The O'Reilly Factor" on Wednesday, Abbot said he plans to sue "because we believe what the president is doing is completely unconstitutional. He has a legal obligation to enforce the laws."
Abbott cited two possible bases for a legal challenge: Article 2, Section 3 of the U.S. Constitution, or the "Take Care" clause, which states that the president must take care to execute all laws; and Article 1, Section 8, which gives the Congress the authority to enact immigration laws.
"We have seen in Texas the consequences and we've dealt with them from a cost perspective of the president's immigration policy," Abbot said, citing the thousands of children who flooded across the Texas border earlier this year.
Abbott and other Republicans attribute that surge to Obama's signing of the Deferred Action for Childhood Arrivals program.
