Fulton County District Attorney Fani Willis is fighting a subpoena, which calls on her to testify in the divorce proceedings involving a prosecutor she is accused of having an improper relationship with.
Willis had hired attorney Nathan Wade to serve as special prosecutor in her election interference case against former President Donald Trump. The Washington Examiner said Willis filed a motion on Thursday to try to quash a subpoena for her testimony in Wade's divorce case.
Earlier papers filed in the election interference case alleged Wade used Fulton County funds his law firm received to pay for vacations he took with Willis, according to the Atlanta Journal-Constitution.
Further, the newspaper noted county records reveal Wade has been paid about $654,000 in legal fees since January 2022. Willis' office authorizes his payments.
Those court papers were filed by attorneys for defendant Michael Roman, a former campaign official for Trump. The documents contain a motion, which claims criminal charges in the case are unconstitutional, and the papers seek to have the charges against Roman dismissed.
Now, in papers filed by Willis in Wade's divorce case with wife, Jocelyn, she maintained she lacks personal knowledge of any matter that is relevant to the divorce, but she did not directly acknowledge the accusations against her. She said there was no reason for her testimony as the Wades had declared their marriage "irretrievably broken."
"It is well-established that when both parties in a divorce proceeding assert that a marriage is irretrievably broken, which is a legal conclusion signifying that there is no hope for reconciliation, there is no genuine issue of fact that remains to be decided concerning the divorce," Cinque Axam, lawyer for Willis, wrote in the filing.
The filing also stated that Jocelyn Wade had "conspired" with "interested parties" in the Trump case "to annoy, embarrass and oppress" Willis.
Andrea Dyer Hastings, a lawyer for Jocelyn Wade, said she was preparing a response that she would file in court.
But Nathan Roman's lawyer, Ashleigh Merchant, told The New York Times: "Ms. Willis alleges that her deposition is being sought in an attempt to harass and damage her professional reputation. Why would her truthful testimony risk damaging her reputation?"
