Eight former general counsels for the House of Representatives have filed court papers in support of a House lawsuit trying to prevent President Donald Trump from spending billions of dollars on a wall along the southern border, Politico is reporting.
“Congress has voted not to provide $8 billion for a border wall, doing so after a drawn-out standoff with the executive branch that led to the longest government shutdown in history,” said the lawyers in a court brief filed Monday. “Congress has used all of the political tools in its box.”
The House had filed a lawsuit in federal court in April after the president had said he would use $8.1 billion in military construction and drug interdiction funds to construction the wall. His announcement came after Congress had appropriated $1.37 billion for border fencing projects, Politico noted.
The former House general counsels in support of the House suit are Kerry Kircher, Geraldine Gennet, Irving Nathan, Steven Ross, Thomas Spulak, and Stanley Brand. Former acting general counsels William Pittard and Charles Tiefer are also backing the lawsuit.
Trump had declared a national emergency in February in an attempt to use the money for a border wall. The president has defended the declaration, saying it is needed to curb the flow of Central American migrants into the U.S. from Mexico.
