N.H. AG: Texas Company Behind Deepfake Biden Robocalls

A Texas-based company is accused of being involved in an artificial intelligence-generated robocall scheme to deceive Democrat voters by using a clone of President Joe Biden's voice to encourage them not to vote in the New Hampshire presidential primary on Jan. 23.

Republican New Hampshire Attorney General John Formella said Tuesday his office's Election Law Unit, in coordination with a nationwide anti-robocall task force that includes the Federal Communications Commission Enforcement Bureau, identified the source of the calls as Life Corporation and its principal owner Walter Monk.

Formella launched a criminal investigation, but no charges have been filed.

"Ensuring public confidence in the electoral process is vital," Formella said at a news conference. "In law enforcement, I can say it is one of our highest priorities. … Our message is clear: Law enforcement across the country is unified on a bipartisan basis and ready to work together to combat any attempt to undermine our elections."

Formella said the robocalls' messages included: "It's important that you save your vote for the November election," and "Your vote makes a difference in November, not this Tuesday." Formella said the calls were made Jan. 21, two days before the primary.

The robocalls also spoofed caller ID information to appear to come from a number belonging to a former New Hampshire Democratic Party chair. The message instructed recipients to call the number belonging to that person to be removed from future calls.

Biden won the primary with 63.9% of the vote through a write-in campaign because his name was not on the ballot. Just over 124,000 Democrats voted in the primary.

Formella's office said in a news release that it's unknown how many calls were made but that Nomorobo, a national call monitoring service, estimated the total was between 5,000 and 25,000.

Formella's office on Tuesday issued a cease-and-desist order to Life Corporation for violating a state law that prohibits voter suppression. It also issued document preservation notices and subpoenas for records to Life Corporation and to multiple other entities, including Lingo Telecom, which has been accused of carrying the robocall traffic.

Also on Tuesday, the FCC issued a cease-and-desist order to Lingo Telecom to stop supporting unlawful robocall traffic on its networks and another order that strongly encourages other providers to refrain from carrying suspicious traffic from Lingo.

"Consumers deserve to know that the person on the other end of the line is exactly who they claim to be," FCC Chair Jessica Rosenworcel said in a news release.

Formella's office said after Lingo Telecom was informed the calls were being investigated, it suspended services to Life Corporation.

"We are committed to keeping our elections free, fair and secure," Formella said. "We will not tolerate any action that seeks to undermine the integrity of our elections and our democratic process. The message to any person or company who would attempt to engage in these activities is clear and it's simple. Don't try it."

Limited information on Life Corporation and Monk was available online and the company doesn't appear to have a website. The Better Business Bureau identified the company as an advertising agency in Arlington, Texas, and a number listed went straight to voicemail when called. Newsmax left a message seeking comment.
