South Carolina Republican Rep. Nancy Mace joined Democrats Monday in calling on the Food and Drug Administration (FDA) to ignore a Texas judge’s ruling that blocks its approval of abortion-inducing drug mifepristone.
“I agree with ignoring it at this point,” Mace told CNN when asked what the Biden administration should do about the ruling. “There are other lawsuits that are happening right now and other states as well over this issue.”
On Friday, U.S. District Judge Matthew Kacsmaryk, in Amarillo, Texas, signed an injunction directing the FDA to halt mifepristone’s approval while a lawsuit challenging the safety and approval of the drug plays out.
On the same day, Spokane, Washington-based federal Judge Thomas Rice blocked the FDA from making any changes to the drug’s access in the 17 Democrat-led states that sued over the matter.
The issue may ultimately be decided by the Supreme Court.
The Palmetto State Republican sided with New York Rep. Alexandria Ocasio-Cortez and Oregon Sen. Ron Wyden, both Democrats, who have said the Biden administration should ignore the Texas injunction.
“The interesting thing when it comes to a ruling is that it relies on enforcement,” Ocasio-Cortez told CNN Sunday. “And it is up to the Biden administration to enforce, to choose whether or not to enforce, a ruling.”
In a tweet on Friday, Wyden said, “This devastating ruling has no basis in law and will ban the most common method of abortion in EVERY single state. President Biden can and must ignore this ruling and keep mifepristone on the market and accessible for every woman in America.”
The Biden administration filed a bid Monday for an emergency stay of the Texas ruling, according to a court filing.
A sexual assault survivor, Mace has been a vocal critic of anti-abortion legislation that does not allow exceptions for rape and said that the issue of abortion is hurting Republicans.
“This is an issue that Republicans have been largely on the wrong side of,” the congresswoman told CNN. “We have, over the last nine months, not shown compassion towards women … Just a few weeks ago we had some folks in the [South Carolina] state legislature that essentially wanted to execute women who had abortions.”
“So, we’ve got some extreme views on this issue, but 90% of America is somewhere in the middle,” she continued. “And I think that that 90% would be okay with listening to the FDA rather than a judge who used an old law that was determined unconstitutional by the Supreme Court.”
