President Donald Trump's emergency declaration to build a border wall will be struck down by the Supreme Court, Sen. Rand Paul, R-Ky., is predicting.
In an opinion piece for Fox News posted Sunday night, Paul — a frequent Trump ally who broke away to oppose the emergency declaration — warned it might be Trump's own nominees, Justices Neil Gorsuch and Brett Kavanaugh, who will "rebuke him on this."
"Without question, the president's order for more wall money contradicts the will of Congress and will, in all likelihood, be struck down by the Supreme Court," Paul wrote.
"Congress clearly expressed its will not to spend more than $1.3 billion and to restrict how much of that money could go to barriers," Paul argued. "Therefore, President Trump's emergency order is clearly in opposition to the will of Congress."
The president predicted last month the 9th U.S. Circuit Court of Appeals would block his move to fund the border wall, but said he hoped to "get a fair shake" and win before the high court, "just like the [travel] ban."
