Senate Close to Confirming Biden's 200th Federal Judge

By    |   Tuesday, 21 May 2024 10:52 AM EDT

President Joe Biden has surpassed former President Donald Trump's pace in judicial confirmations.

Arizona district court nominees Krissa Lanham and Angela Martinez were expected to be confirmed by the Senate on Tuesday.

That will allow Biden to reach the 200 mark in federal judges confirmed. Although the Heritage Foundation tracker shows his pace has surpassed that of his predecessor, Biden will find it hard to top Trump’s overall total of 234 judicial confirmations with an election-year legislative calendar, Politico reported.

Senate Majority Leader Chuck Schumer, D-N.Y., said Biden’s milestone "shows how intensely focused we are on filling the bench with jurists who will make our democracy stronger and uphold the rule of law."

On Monday night, the Senate approved a federal prosecutor in New Hampshire to a seat on the 1st U.S. Circuit Court of Appeals.

Seth Aframe, who heads the criminal division of the U.S. Attorney's Office for the District of New Hampshire, was confirmed to the Boston-based appeals court, which hears cases from Maine, Massachusetts, New Hampshire, Rhode Island, and Puerto Rico.

Aframe was confirmed 49-40 after receiving support from law enforcement, bar presidents, as well as prosecutors and defense attorneys, Bloomberg Law reported.

Republicans on the Senate Judiciary Committee had criticized Aframe over what they considered insufficient sentencing recommendations in certain cases.

"Mr. Aframe is uniquely qualified to serve as a judge on the Court of Appeals," former assistant U.S. attorneys in New Hampshire said in a letter to the Judiciary Committee.

Biden nominated Aframe in October after Michael Delaney withdrew from consideration.

Delaney, a former New Hampshire attorney general, withdrew after some Senate Democrats raised concerns about a legal brief Delaney signed defending a New Hampshire law, since repealed, that required parents to be notified before their minor child has an abortion.
