Trump Seeks Presidential Immunity From State Lawsuits

By    |   Tuesday, 28 January 2025 05:25 PM EST

President Donald Trump is beseeching a court for presidential immunity from civil lawsuits filed against him in state court, arguing that they are a “distraction” from carrying out his duties in the White House, ABC News reported Tuesday.

Trump, along with co-defendants Kash Patel and White House Deputy Chief of Staff Dan Scavino, are being sued by Trump Media & Technology Group co-founders Andy Litinsky and Wes Moss over claims that Trump and his executive team prevented them from getting a full stake after the company went public.

Trump attorneys argued in a filing last Friday that he should have temporary presidential immunity, ABC News reported.

"Without the protections of temporary Presidential immunity, the President will be forced to defend against these cases — and the many more that are sure to arise during his second term — all to the detriment of his office and the American people he serves," attorneys John Reed and Theodore Kittila wrote in Delaware Chancery Court.

The attorneys are asking for a four-year delay or an outright dismissal of the lawsuit, according to the report.

"State courts across the country are being called upon to sit in judgment of the sitting President, to tax his time, and to second-guess his priorities. That state of affairs — President Jefferson's nightmare — dishonors the Presidency and debases the state courts that purport to control his actions," the filing said, according to the report.

Litinsky and Moss filed the lawsuit last February and Trump countersued in April, arguing they set up the company improperly.

Delaware Chancery Court Judge Morgan Zurn temporarily paused the claim in December so Trump's legal team could make the immunity argument, according to the report.
