Judge Napolitano to Newsmax: Tough to Prove Willis Case

Former New Jersey Superior Court Judge Andrew Napolitano told Newsmax on Monday that although Judge Scott McAfee comments were "huge," nevertheless, Donald Trump's co-defendant will have a challenging time proving the allegations of misconduct against District Attorney Fani Willis.

"It's not going to be an easy task for the co-defendant to prove," Napolitano said during an appearance on Newsmax's "Carl Higbie FRONTLINE," referring to the allegations made by Michael Roman, a Trump co-defendant in the Fulton County election interference case, that Willis had a romantic relationship with special prosecutor Nathan Wade, that they used taxpayer dollars to finance their vacations and that it was this relationship that caused Willis to hire the previously underqualified Wade.

Yet, according to Judge Napolitano, the challenge will be showing that this personal relationship caused Willis and Wade to improperly prosecute the Trump case. "What Trump's co-defendant must show is that as a result of that relationship, decisions were made in the case, not in the best interest of the case or the clients, the people of Fulton County, but in the interest of hiding their relationship," he said.

Napolitano said that Willis will likely be grilled on decisions she made regarding the Trump election interference case and that her files are going to need to be examined. Yet, because she is in the midst of a criminal trial, the contents of those files will not be known prior to any impending trial involving her alleged misconduct.

"Part of the files are secret because it is still a criminal prosecution and there are parts of that file that the state is entitled to keep secret until they're actually in the courtroom," Napolitano said.

According to the court filings by Roman's attorneys, Willis and Wade began a relationship in 2019 and Wade has been paid over $653,000 by Fulton County since being hired in 2021.
