Fraud Attorney Allen: Claim of Lost Emails is IRS Cover-Up

Don't believe the IRS for a minute when it claims to have forever lost emails written by Lois Lerner, an alleged kingpin in the agency's tea party-targeting scandal, investment fraud attorney John Lawrence Allen says.

"It’s so beyond comprehension,'' Allen, a former hedge fund manager  district attorney and author of  "Make Wall Street Pay You Back,'' told "The Steve Malzberg Show" on Newsmax TV. "I have a small office, and I have a backup on the [Microsoft] Cloud, I have a backup on iBack, I have a backup on a hard drive, I have a backup on a tape.

"You're going to tell me that the IRS that maintains excellent records of our income and our disbursements can't keep a hold of their emails? It's improbable, impossible, it's clearly a cover-up.''

The IRS is currently being probed by the House Ways and Means Committee for allegedly targeting conservative groups seeking tax-exempt status.

Lerner, who resigned from her post after the scandal exploded, has refused to answer questions about what role she played.

The House wants to see emails written by Lerner, but last week the IRS said many of them were destroyed in a computer crash.

Allen said it "defies imagination'' that the emails can't be retrieved.

He also believes Lerner must eventually testify because she first insisted on her innocence before pleading the Fifth Amendment against self-incrimination.

"If you make an opening statement, and then you claim the Fifth later, any comments you make, anything that opens a door … is admissible,'' Allen said. "And they are allowed to go after that.''
