Jordan Sekulow to Newsmax TV: SCOTUS Case Hinges on 'Standing'

The Pennsylvania election challenge before the U.S. Supreme Court might be able to break through and establish "standing," leading to more SCOTUS cases in other states, according to a member of President Donald Trump's legal team Jordan Sekulow on Newsmax TV.

"If the court is more open to standing on this issue, because of who brought the challenge," Sekulow told Monday's "Stinchfield," "if it can survive that, then you can bring this forward from Georgia, you could bring if from Wisconsin, you could bring something similar from Michigan."

Sekulow told host Grant Stinchfield, the case in point is "courts were making up the rules" on election law. That is unconstitutional, in that, election law should be decided by legislatures and not elections officials or state courts.

Sekulow did admit there is precedent for those elections to be accepted if states followed the new procedures as "best they could."

"But, if we can get past the standing issue, I think it's significant and you can kind of duplicate this in other states," Sekulow concluded.

In another issue, Sekulow rejected former Overstock CEO's Patrick Byrne's claims White House legal counsel Pat Cipollone is a leaker within the White House inner circle.

"This is no way Pat Cipollone is doing anything or leaking anything as White House counsel to damage the president," Sekulow said. "There may be somebody in that room. I'm not saying that, but to put the blame on some of these actors who may have been just been raising legal issues with the president.

"And, by the way, the meetings with the president get pretty heated, Grant. This is a guy who likes the back and forth."
