AG Paxton to Newsmax: Texas Won't Comply With DHS Open Border Policy

Texas Attorney General Ken Paxton told Newsmax on Wednesday that Texas will not comply with the Biden administration's open border policy.

In a letter to Paxton, Department of Homeland Security General Counsel Jonathan Meyer warned the attorney general that "if you have not confirmed by the end of day on January 17, 2024, that Texas will cease and desist its efforts to block Border Patrol's access in and around the Shelby Park area and remove all barriers to access to the U.S.-Mexico border, we will refer the matter to the Department of Justice for appropriate action and consider all other options available to restore Border Patrol's access to the border."

In response, Paxton told "The Chris Salcedo Show," he "sent a letter back saying, 'We're not going to follow their directives. It's insane.'"

"So it's shocking to me the way they wrote that letter," Paxton added, "because it sounds like they're telling us to get out of the way so they can enforce immigration law. When in reality, they're not enforcing any immigration law. They're doing just the opposite. They're bringing them in. So, it doesn't make any sense at all.

"They want us to move out of the way so that they can continue to violate federal law to violate Biden's constitutional role to implement federal law.

"It's not his job to make up new laws, but that's exactly what they're doing. And here we are just trying to protect our citizens from crime, from drug importation, from sex trafficking, from just having to deal with millions of people crossing the border in the last three years, and they're telling us, No, get out of the way. Let that happen. You shouldn't protect your own citizens ... just set aside."

"But we're not willing to do that," Paxton proclaimed.

DHS' Wednesday deadline for Paxton to respond falls the day before DHS Secretary Alejandro Mayorkas was slated to appear before the House for an impeachment proceeding. But DHS sent a letter to Homeland Security Committee Chair Mark Green, R-Tenn., on Wednesday stating Mayorkas would not attend.
