President Donald Trump is stuck between a wall and a hard line, because – as Rep. Louie Gohmert, R-Texas, told Newsmax TV – a national emergency declaration would just get gummed up by hardline Democratic resistance in courts.
"The Democrats have made clear, they're going to be rushin' into court, and they're hoping he would declare a national emergency, so they can stop him," Gohmert said during an appearance on "Newsmax Now" Tuesday. "And that gets them off the hook.
"They know, the Democrats, 'Gee, if we can get the president to declare a national emergency, then we're off the hook. Then there's no pressure on us to build a barrier. We don't look like the hypocrites we are for being unwilling to fund that, and then we can just stop him in court.'
"And that's some of the talk around here."

Trump has compromised to reopen the government for a temporary negotiation period in Congress, but Gohmert says a $5.7 billion border wall deal with Democrats is "unlikely" to be made in time to avoid another government shutdown.
Expect a national emergency, which ultimately would provide no immediacy anyway, according to Gohmert.
"There's no question in my mind this is a national emergency, even more so than when President [Barack] Obama declared the bird flu – I mean that was tragic, there were some people that died from that – but nothing on the order of [border security]," Gohmert told host John Bachman.
Gohmert added a rip to Senate Minority Leader Chuck Schumer's not only opposing the wall, but also shutting out the president and closing the debate from the public.
"The president wants this public so the American people know who's selling them out, but the Democrats don't want the American people to know," Gohmert concluded.
