Rep. Louie Gohmert, R-Texas, downplayed the certification of election results in Pennsylvania and Nevada, saying lawsuits challenging the outcome were still working their way through courts, and even legal setbacks are part of the process to get the matter before the U.S. Supreme Court.
Gohmert, 67, who served as a state district judge and chief justice on Texas' 12th Circuit Court of Appeals, told Newsmax TV's "American Agenda" on Tuesday that attorneys for President Donald Trump probably expected courts in some states to be hostile to their claims.
"It's not up to litigants to show the evidence to professors, it's presenting that to the judges, that's where it's supposed to go," Gohmert told host Bob Sellers. "And even though there [are] unfriendly courts in Pennsylvania, that's laying the groundwork to get to the Supreme Court, where this ultimately needs to be decided."
Gohmert, who has represented Texas' 1st Congressional District along the border with Louisiana since 2005, said he might not expect any change in court results anytime soon.
"No, I don't think it does at all," Gohmert said. "You've got to put evidence in at the trial court level, even though you know you're in unfriendly territory, because the goal is to put your evidence in there. The only thing supposed to be considered by appellate courts are things of which they can take judicial notice without actually having had them introduced into evidence.
"Now, I've seen evidence that there are some liberals on the Supreme Court that have just considered whatever they wanted to. That's highly unethical and inappropriate. But appropriately, you get evidence in before the trial court, knowing that you're laying the foundation, you're building brick by brick what you want to get before the Supreme Court. And that's being done. And keep in mind, the election just happened just over two weeks ago, and it takes time to do the research and dig out evidence."
