Dershowitz: Comey 'Acted Absolutely Improperly' in Leak

Former FBI director James Comey was wrong to leak one of his memos to the media via a middle man, Harvard Law School professor Alan Dershowitz told Newsmax TV.

During an appearance on Tuesday's "America Talks Live," Dershowitz spoke about the Comey situation with host Miranda Khan.

"This is information he obtained as director of the FBI," Dershowitz told Khan. "He wrote those notes contemporaneously. They are the property of the United States of America. And he has no right to treat them as personal property. He couldn't destroy them. They are the government's property, number one.

"Number two, he acted absolutely improperly as the former director of the FBI leaking material and laundering it through a friend, a law professor. That suggested he knew what he was doing was wrong."

Comey wrote memos detailing his conversations with President Donald Trump this year. After Trump fired him, Comey gave one of the memos to a friend at Columbia Law School for him to leak to the media.

Comey said the tactic was designed to trigger the appointment of a special counsel for the Department of Justice's Trump-Russia probe.

Dershowitz, the author of "Electile Dysfunction," wondered why Comey did not go directly to Congress instead.

"Why didn't he have the courage of his convictions and simply write a letter to Congress saying, 'you ought to appoint a special prosecutor' – or a letter to the director of the Justice Department, the deputy attorney general to the Justice Department – or even go directly to the press himself and say, 'I think these memos show that there ought to be an appointment of an independent or special counsel?'" Dershowitz said. "Why does he launder it through a law professor? The job of the FBI is to stop leaks."
