President Donald Trump's imminent Supreme Court nominee is going to be "crucial, decisive swing vote" not only on attempts to relitigate Roe v. Wade, but also on any rulings needed from special counsel Robert Mueller's investigation, said Sen. Richard Blumenthal, D-Conn., who is going to ask that the justice to recuse themself from such a vote.
"This next nominee will be a crucial, decisive swing vote on whether the president can be held accountable on his financial dealings, and on whether the special counsel investigation can be proceeded to finish," Blumenthal told "The Cats Roundtable" on 970 AM-N.Y. "He [or she] will be the swing vote in deciding whether the president can be compelled to testify before the grand jury or whether he can pardon himself or others. . . .
"On those issues I will expect this nominee to commit explicitly and specifically that she or he will disqualify themselves — another word is recuse themself — because there's too deep a conflict of interest."
Blumenthal, a notorious Trump critic, said he has "deep and serious concerns" about Trump's reported leading Supreme Court candidates.
"They are on a list of generally far-right, fringe ideologues, who've been carefully vetted by groups that are listening to the president — that he will nominate someone only who will overturn Roe v. Wade . . . or who will dismantle essential healthcare rights . . .
"So, I'm going to be asking really tough questions."
Blumenthal told host John Catsimatidis a key issue for the next justice nominee will potentially be determining whether a subpoena of the president is constitutional — on which Blumenthal's mind is already made up.
"That subpoena is not only enforceable, it is legal," he told Catsimatidis. "And the United States Supreme Court in my view would have to decide that the president can be compelled to testify. So, I think there is a looming constitutional confrontation here that will force Donald Trump to be interviewed, testify before the grand jury.
"We are heading for a constitutional confrontation that would be a self-inflicted wound by Donald Trump if it occurs. Only Donald Trump's intransigence, defiance of the rule of law would precipitate such a confrontation. It happened under the Richard Nixon tapes case."
