Constitutional lawyer Jenna Ellis told Newsmax TV Tuesday that former Minneapolis police officer Derek Chauvin did not get a fair trial in his conviction for the death of counterfeiting suspect George Floyd, suggesting his conviction will be overturned on appeal.
“Did Derek Chauvin get a fair trial? That’s going to be the question on appeal,” said Ellis, who was an attorney to the 2020 Trump presidential campaign. “And I don’t think he did. I think if the appellate court is looking at all of the factors here, they’re going to overturn this on appeal and give him a new trial.”
Citing decisions by trial Judge Peter Cahill who did not sequester the jury, move the trial or declare a mistrial following public remarks by Rep. Maxine Waters, D-Calif., that appeared to suggest violence to a crowd if Chauvin was not convicted, Ellis found numerous grounds for appeal.
“Did the jury actually and true and sound verdict and did Maxine Waters’ comments, Joe Biden’s comments earlier today, would they have reached the same verdict, or were they influenced?” Ellis said on “Stinchfield.” “That’s why the appearance of bias is so important, because due process requires that a fair and impartial jury hear the facts? They’re fact finders, not emotional justice warriors.”
Ellis, who has served as both a prosecutor and a defense attorney, said due process did not function in a constitutional sense.
“Did Derek Chauvin get a fair trial? I don’t think he did,” Ellis said. “So in that sense, true justice wasn’t served. Social justice warriors are declaring victory. Joe Biden’s remarks right after the verdict were about racial inequality and this was somehow about Chauvin in a bigger context.
“The people who are interested in taking a personal stake in this, are thinking this is about collective corporate white guilt. That’s not at all what this trial was about.”
