Jared Kusher, not Donald Trump Jr., is the one who potentially faces greater legal problems for taking a meeting with a foreign agent, a former assistant FBI director told The Daily Signal.
Kushner — and former campaign chairman Paul Manafort — had a legal obligation that didn't and doesn't exist with Trump Jr., former assistant FBI director Ron Hosko told the Daily Signal.
"Today I would say that Donald Jr. was not a member of government and does not have a legal obligation," Hosko told the Daily Signal. "If it is proven that Donald Trump Jr. was gleefully willing to go to a meeting with a Russian agent, the question is still: What is his legal obligation?"
Hosko's analysis echoes that of famed legal scholar Alan Dershowitz, who came at it from a different direction.
"You are allowed legally to use material that was obtained illegally, as long as you had nothing to do with the illegal nature of obtaining the information," Dershowitz told Newsmax TV, assuming worst-case scenario for Trump Jr.
President Donald Trump's son-in-law Kushner, on the other hand, was a steward of his campaign and is a senior adviser in the White House.
"Now that is different," Hosko said of Manafort and Kushner. "They are more directly affiliated with the campaign, and one is serving in government."
