Alan Dershowitz says President Donald Trump should allow his administration to cooperate with the Biden team on a transition.
"He's not going to officially concede. He's not going to stop the challenges. Should he allow his team to begin to cooperate with the Biden team on the transition? I don't see any reason why he shouldn't do that," Dershowitz said Sunday during Newsmax TV's special election coverage.
"You can do that without conceding, without eliminating the challenge. It helps for the flow of governance in the event that Biden ends up winning, which is the likely event, you've helped him begin the national security transition process. I think he ought to begin to cooperate on the transition without necessarily conceding or ending his challenges."
Dershowitz also said Trump would win the Pennsylvania legal challenge but doubted the Supreme Court would get involved and give him that victory, "although if it did make a difference, my own prediction is that they would give him the victory."
Trump has refused to concede the presidential election, citing voter fraud, though many news outlets have called the race for Democrat Joe Biden.
His campaign continues to challenge the results of the election in court as his administration is holding up the formal transition process, which has resulted in a delay of millions of dollars in funding and the provision of other government resources for the effort.
A number of prominent Senate Republicans including Sens. James Lankford (Okla.), Marco Rubio (Fla.) and Roy Blunt (Mo.) have also called for Biden to start getting briefings.
