Even though the Biden administration will request that U.S. attorneys appointed by former President Donald Trump resign, a senior Justice Department official told Fox News that David Weiss, the prosecutor overseeing the tax investigation linked to Hunter Biden, will be asked to remain.

It is common for new presidents to request the resignation of all U.S. attorneys upon entering office, but Biden has vowed to restore the Department of Justice’s (DOJ) independence from the White House and administration officials have not taken a stand when previously asked by Fox if it meant to also get rid of Weiss.

The DOJ has been investigating the finances of the president’s son since 2018, including looking into some of his Chinese business dealings and other transactions.

Trump and his backers have accused Hunter Bidden of profiting from his political connections, including while his father was vice president in the Obama administration.

A senior official also told Fox that John Durham, the U.S. district attorney in Connecticut who was named special counsel to look into the origins of the FBI investigation into the 2016 election, will resign from his position, but will remain in his position as special counsel.

Durham was chosen by then-Attorney General William Barr to investigate whether any federal official broke the law in connection with the investigation into the 2016 presidential campaigns and people associated with the Trump administration, according to NPR.
