Walmart has filed a complaint arguing that the proposed logo for Kanye West's Yeezy brand too closely resembles its own.
In its opposition filed to the U.S. Patent and Trademark Office last week, Walmart stated that Yeezy's proposed design was "likely to cause confusion, mistake and deception" among consumers and potentially create a "false affiliation" that could "injure and damage" Walmart.
Yeezy's proposed logo consists of eight dotted lines arranged in a star-like pattern while Walmart's logo, which the company has used since 2008, has six rays in a circle with rounded ends.
Walmart declined to comment to Fox Business but a spokesperson did refer the outlet to a letter that was sent to Yeezy's lawyers days before the retail giant filed the notice of opposition. According to the letter obtained by Fox Business, Walmart had attempted to make contact with West's company multiple times. Most recently there was a telephone conference last month.
"Walmart has repeatedly sought to understand Yeezy's planned use of the Yeezy Application, with the goal of finding ways in which the Walmart Spark Design and the Yeezy Application can co-exist with one another," the letter said. "However, to date, we have not received any conclusive information from Yeezy regarding the planned use or any cooperation from Yeezy in order to find common ground."
This is not the first lawsuit West’s company has faced. Last year a company filed a $20 million suit claiming West had stolen its technology to bump up sales on his Yeezy line of shoes and clothing, which he sold at his 'Sunday Service,' gigs.
The rapper allegedly rebranded the work of MyChannel, Inc. — a company that specializes in video and e-commerce technologies — and used their ideas as his own while meeting with companies like Adidas to discuss his clothing brand, according to court documents viewed by Pitchfork. MyChannel execs also claimed that West used a copied version of their technology to sell his merch.
West was further accused of not living up to his promise of investing $10 million into the company and for failing to pay MyChannel for six months' work, according to legal documents obtained by The Blast.
