Rachel Canning Back Home as Lawsuit Against Parents Continues

Rachel Canning is home living with her parents again, after suing them to get them to support her after she moved out of their New Jersey home late last year.

Canning "returned home and reunited with her parents and siblings," the parents' attorney Angelo Sarno, said in a statement Wednesday, the Star-Ledger reported.

"Her return home is not contingent on any financial and/or other considerations," Sarno added.

Canning, a cheerleader and an honors student at Morris Catholic High School in Denville, N.J., returned to her parent's Lincoln Park home this week after a judge refused to grant the 18-year-old's request for immediate financial support earlier this month. Despite the setback in Canning's suit, the case will reportedly continue and is scheduled to again be evaluated by the court in April.

"This is a long process," Sarno added. "It's only the beginning."

The 18-year-old asked the court not to emancipate her from her parents and to declare her dependent on them for support, demanding that her parents not only settle her outstanding high school tuition, but also turn over an existing college fund.

"My parents have rationalized their actions by blaming me for not following their rules," Rachel said in court papers, according to The Daily Record of Morristown, N.J. "They stopped paying my high school tuition to punish the school and me and have redirected my college fund, indicating their refusal to afford me an education as a punishment."

Canning reportedly wants to be a biomedical engineer and has been accepted to several schools. She has been offered a $20,000 scholarship to attend the private University of Vermont.

According to the 18-year-old's parents, Canning moved out from their house because she didn’t want to follow house rules, in particular rules concerning her boyfriend, whom the parents disapprove.

Canning was staying with her best friend in Rockaway Township.

During the trial, Canning’s father, Sean Canning — a retired Lincoln Park police chief, disputed his daughter's assessment of the situation and said that she voluntarily left last year and was never thrown out.

"We love our child and miss her," Sean Canning said, according to the Daily Record. "This is terrible. It’s killing me and my wife. We have a child we want home. We’re not Draconian and now we’re getting hauled into court. She’s demanding that we pay her bills but she doesn’t want to live at home and she’s saying, 'I don’t want to live under your rules.'"
