Student Alleges Rape, Sues Frat at Wesleyan University After Wild Party

A Wesleyan University student has sued a fraternity after she was allegedly raped in front of a crowd of people at a campus frat party.

The lawsuit names the Xi Chapter of Psi Upsilon, 11 of its members, and the alleged assailant, according to CNN. It also demands a jury trial.

At a party the lawsuit describes as "wildly out of control," freshman Cabri Chamberlain found herself at a pledge "strip show," where many "underage and extremely intoxicated" undergraduates danced with naked pledges.

While trying to collect her jacket and leave, Chamberlain was allegedly picked up from behind, thrown over the leg of a couch in the common room, and raped in front of "numerous others," the lawsuit says, according to CNN.

After the incident, Wesleyan public safety officers took the victim to a nearby hospital. A diagnosis of sexual assault was documented.

Chamberlain has taken a break from her studies, and released the following statement via her lawyer to CNN:

"I'm proceeding in this case with my real name instead of 'Jane Doe' because as the victim of a heinous violent crime I've done nothing wrong and have nothing to be ashamed of. I can't even describe the pain of being raped, or how much it alters a life, and no other person should ever be forced to have that experience. I hope my experience and lawsuit will create changes that protect others."

The Connecticut university, which is not named in the suit, said in a statement written by President Michael S. Roth that Wesleyan's internal investigation led to the expulsion of the alleged assailant, and sanctions against the fraternity and some of its members.

"On behalf of the university community, I want to express our horror at this shameful assault. Sexual violence on college campuses is a national problem, and it's important to raise awareness about this issue," Roth said.

Chamberlain's lawyer, Douglas Fierberg, told CNN, "Fraternity self-management has historically proven itself to be flawed and dangerous. Women have been raped because of this mismanagement. People have died because of this mismanagement. And this victim will hold the fraternity responsible for its tradition of dangerous mismanagement."

Another Wesleyan student sued the university in 2012 over a rape she alleged happened at another fraternity house two years prior. The university settled in court-ordered mediation, and Wesleyan no longer recognizes the student organization.
