The American Civil Liberties Union said it would seek a court injunction blocking President Donald Trump's diversion of $3.6 billion from military construction projects for his wall on the southern U.S. border with Mexico.
The injunction is part of the ACLU's lawsuit filed in February challenging Trump's use of emergency powers to secure funding that Congress had denied for the wall.
"The fact that the government sat on these so-called 'emergency funds' for seven months further confirms that this is nothing but an unlawful power grab," Dror Ladin, staff attorney with the ACLU's National Security Project, said in a statement Tuesday.
"We'll be back in court very soon to block Trump's latest effort to raid military funds for his xenophobic wall," he said.
Defense Secretary Mark Esper had approved the use of $3.6 billion to build 175 miles of Trump's border wall.
But Pentagon officials would not say which 127 military projects would be affected by the diversion, adding that details would be available Wednesday after Congress was notified.
Half the money would come from military projects in the U.S., and the rest from projects in other countries, officials said.
Elaine McCusker, the Pentagon comptroller, said the money would be used to build 11 border projects.
