Witness: Michael Brown Had 'Hands in the Air' When Shot

By    |   Wednesday, 10 September 2014 09:10 PM EDT

Two contractors in Ferguson, Missouri, who witnessed Michael Brown's killing say police officer Darren Wilson shot the unarmed teen while he was surrendering, according to a new video obtained by CNN.

In the cellphone video, shot by a third party, the two men can be seen and heard saying that the unarmed black teenager had his hands up when the final shots were fired. The two men were about 50 feet away from Brown and Wilson, CNN reported.

"He had his . . . hands in the air," the first contractor said. "Man, he was going like this," he said as he raised his own hands.

The man told CNN he heard one gunshot, then, 30 seconds later, another. Then he saw Brown "staggering" and "put his hands up and said, 'OK, OK, OK.'"

"The cop didn't say get on the ground, he just kept shooting," the witness told CNN, and he then saw Brown's "brains come out of his head."

The second contractor said that he saw Brown running from the officer and that Wilson was chasing him. Brown put his hands up. Wilson, a white officer, fired a shot at Brown while his back was turned, the man told CNN.

Brown "staggered dead after the second shot 20-25 feet to the ground," the second man told CNN. "He was like a walking dead guy."

Another officer arrived soon afterward and pulled his gun, but did not shoot, the man said.

A third man, whom the contractors said they do not know, can be heard on the tape saying, "He was no . . . threat at all."

The two contractors are not from the Ferguson area and don't know Brown's family or the police officer involved. They were the only two white people in the crowd besides police and decided to "get the hell out of there before it got ugly," the second contractor said.

He told CNN they asked a police officer on the scene why they were leaving Brown's body uncovered and were told they were doing so to protect evidence.

Their story matches those of several other witnesses who live in the neighborhood.

Witnesses on the scene have criticized police for leaving Brown's body in the middle of the street for four hours.

The Aug. 12 killing of Brown has sparked weeks of protests in the area, with rioting occurring from some people in the crowds during overnight hours. The Justice Department is investigating the shooting, as racial tensions have risen as a result.
